Terms of Service

1.Eligibility

You must be at least 18 years old to use the Services. By creating an account or using the Services, you represent and warrant that:

• you are at least 18 years old;
• you are legally able to enter into a binding agreement;
• you will comply with these Terms and all applicable laws; and
• all information you provide is accurate, current, and complete.

We do not allow individuals under 18 to use the Services.

2.About the Services

Find My Partner is a partner finding platform designed to help adult users connect with other adult users. The Services may include user profiles, matching features, private messaging, verification tools, location-based features, subscriptions, advertising-supported features, and related functionality.

We do not guarantee that you will find a match, form a relationship, or have any particular experience through the Services.

3.Account Registration and Security

To access certain features, you must create an account. You agree to:

• provide truthful, accurate, and complete registration information;
• keep your information updated;
• maintain the confidentiality of your login credentials;
• be responsible for all activity that occurs under your account; and
• notify us promptly if you suspect unauthorized use of your account or a security breach.

You may not create an account for another person without permission, or create multiple deceptive or fake accounts.

4.Verification and Platform Integrity

To support trust and safety, we may require or offer certain verification features, including:

• email verification;
• phone verification;
• one-time passcode authentication;
• selfie or photo verification.

Verification helps support authenticity and safety, but it does not guarantee that any user is who they claim to be, is acting in good faith, or is safe to interact with. You are solely responsible for exercising caution in your interactions with other users.

5.User Conduct

You agree to use the Services in a lawful, respectful, and safe manner. You must not:

• impersonate any person or entity;
• create fake, misleading, or fraudulent accounts;
• provide false information about your identity, age, relationship status, intentions, or other material details;
• harass, threaten, abuse, stalk, intimidate, or harm another person;
• engage in hate speech, discrimination, or violence;
• post or transmit unlawful, defamatory, obscene, exploitative, or otherwise harmful content;
• use the Services for scams, fraud, solicitation, extortion, blackmail, or coercion;
• request money, financial assistance, or financial account information from other users;
• share another person's private information without consent;
• use the Services for unauthorized commercial purposes;
• advertise products, services, or social accounts without our written permission;
• upload malware, malicious code, or harmful files;
• interfere with the operation, security, or performance of the Services;
• scrape, crawl, copy, harvest, or collect data from the Services by automated or manual means without permission;
• reverse engineer, decompile, or attempt to access non-public portions of the Services;
• violate any applicable law, regulation, or third-party rights.

6.User Content

You may submit, upload, or share content through the Services, including profile details, photos, prompts, messages, and other content ("User Content").

You are solely responsible for your User Content. By submitting User Content, you represent and warrant that:

• you own it or have all rights necessary to share it through the Services;
• it does not violate any law or third-party right;
• it is not false, misleading, abusive, or otherwise prohibited by these Terms; and
• it complies with our policies and applicable law.

We may, but are not obligated to, monitor, review, moderate, restrict, remove, or disable access to User Content at our sole discretion.

7.License You Grant to Us

By submitting or making available any User Content through the Services, you grant Find My Partner a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, perform, distribute, modify, and use that User Content as necessary to operate, provide, improve, promote, secure, and support the Services.

This license is limited to the purpose of operating and improving the Services and ends within a commercially reasonable period after your content is deleted from the Services, except to the extent retention is required for backups, legal compliance, dispute resolution, fraud prevention, safety investigations, or enforcement purposes.

8.Profile Visibility and User Interactions

Because Find My Partner is a partner finding platform, certain information in your profile may be visible to other users, including your name or display name, age, gender, height, photos, city or location, preferences, and profile content.

You understand and agree that:

• other users may view the content you choose to share;
• private messages you send are intended for the recipients you choose, but we cannot control how other users may save, share, or misuse information you provide to them; and
• you are solely responsible for your decisions, communications, and interactions with other users, whether online or offline.

9.Safety Disclaimer

We do not conduct criminal background checks on all users, and we do not guarantee the identity, intentions, behavior, or safety of any user.

Use caution when interacting with others, especially if you choose to communicate outside the Services or meet in person. You are solely responsible for your interactions with other users.

If you believe another user has violated these Terms or poses a risk, you should stop interacting with them and report the account through the app or by contacting us at support@findmypartner.app.

10.Location-Based Features

The Services may use precise or approximate location data to enable matching, discovery, and other location-based features. By enabling location permissions, you allow us to use your device location in accordance with our Privacy Policy.

You may be able to control location access through your device settings, but some features may not function properly without it.

11.Subscriptions and Paid Features

Find My Partner may offer premium or paid features. Subscriptions purchased through the Apple App Store or Google Play are processed and managed by those third-party platforms, and your use of those payment services is subject to their terms and policies.

You understand and agree that:

• subscription pricing, billing cycles, renewal terms, cancellation processes, and refund handling may be governed by Apple or Google;
• we do not control third-party billing systems;
• you are responsible for managing your subscription through the platform where you purchased it; and
• access to premium features may be suspended or terminated if payment is not successfully processed.

12.Free Tier and Advertising

We may offer a free version of the Services that includes advertising. By using the free tier, you understand that advertisements may appear in the app or related Services.

We reserve the right to modify, add, remove, or limit ad-supported or paid features at any time.

13.Termination, Suspension, and Removal

We reserve the right, at our sole discretion and without prior notice, to suspend, restrict, disable, or terminate your account or access to the Services if:

• you violate these Terms;
• you violate applicable law;
• you create risk, legal exposure, or potential harm to us, other users, or third parties;
• we suspect fraud, abuse, harassment, impersonation, or other misconduct; or
• we determine that your use of the Services is inappropriate or harmful.

We may also remove User Content or restrict visibility of profiles or content at our discretion.

You may stop using the Services at any time. You may also delete your account in-app, subject to our data retention practices described in the Privacy Policy.

14.Intellectual Property

The Services, including the app, website, software, branding, logos, trademarks, text, graphics, design, layout, and other materials, are owned by or licensed to Find My Partner LLC and are protected by intellectual property and other applicable laws.

Except as expressly permitted by us in writing, you may not:

• copy, modify, distribute, sell, license, or exploit any part of the Services;
• use our name, logo, or branding without permission; or
• create derivative works based on the Services.

"Find My Partner," related branding, and associated marks are the property of Find My Partner LLC.

15.Feedback

If you provide us with suggestions, ideas, comments, or feedback about the Services, you grant us the right to use that feedback for any purpose without compensation or obligation to you.

16.Privacy

Your use of the Services is also subject to our Privacy Policy, which explains how we collect, use, store, and disclose your information. By using the Services, you acknowledge that you have reviewed our Privacy Policy.

17.Third-Party Services

The Services may integrate with or rely on third-party services, including app store platforms, analytics providers, hosting providers, cloud infrastructure providers, messaging or authentication tools, and other service providers.

We are not responsible for the availability, content, policies, or practices of third-party services. Your use of third-party services may be subject to their own terms and privacy policies.

18.Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE FULLEST EXTENT PERMITTED BY LAW, FIND MY PARTNER LLC DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ACCURACY.

WE DO NOT WARRANT THAT:

• THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
• THE SERVICES WILL ALWAYS BE AVAILABLE OR FUNCTION WITHOUT DELAYS;
• ANY MATCHES, RECOMMENDATIONS, OR COMMUNICATIONS WILL LEAD TO ANY PARTICULAR RESULT;
• ANY USER IS LEGITIMATE, HONEST, SAFE, OR COMPATIBLE; OR
• THE SERVICES OR CONTENT WILL BE FREE FROM HARMFUL COMPONENTS.

19.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIND MY PARTNER LLC, ITS AFFILIATES, OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, REPUTATION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

• YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES;
• YOUR INTERACTIONS WITH OTHER USERS;
• USER CONTENT OR CONDUCT OF OTHER USERS;
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR DATA;
• SERVICE INTERRUPTIONS, BUGS, OR TECHNICAL FAILURES; OR
• ANY OTHER MATTER RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF:

THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR

ONE HUNDRED U.S. DOLLARS (US $100).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

20.Indemnification

You agree to defend, indemnify, and hold harmless Find My Partner LLC, its affiliates, officers, members, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees, including reasonable attorneys' fees, arising out of or related to:

• your use of the Services;
• your User Content;
• your interactions with other users;
• your violation of these Terms; or
• your violation of any law or third-party right.

21.Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of laws principles.

22.Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall first be attempted to be resolved informally by contacting us at support@findmypartner.app.

If a dispute cannot be resolved informally, it shall be resolved exclusively in the state or federal courts located in Ohio, and you consent to the personal jurisdiction and venue of those courts, unless applicable law requires otherwise.

23.Changes to the Services

We reserve the right to modify, suspend, discontinue, or restrict all or any part of the Services at any time, with or without notice, to the extent permitted by law.

We are not liable to you for any modification, suspension, or discontinuation of the Services.

24.Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice through the Services, by email, or by other reasonable means. The "Last Updated" date at the top indicates when these Terms were last revised.

Your continued use of the Services after updated Terms become effective constitutes your acceptance of the revised Terms.

25.Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

26.No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other right.

27.Entire Agreement

These Terms, together with our Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and Find My Partner LLC regarding the Services and supersede any prior agreements or understandings relating to the Services.
